a) According to the prevailing legal opinion, the setting of a hyperlink constitutes access mediation in accordance with § 5 paragraph 3 of the Teleservices Act. This means that the website www.bad-wildbad.de, as a service provider, is not responsible for third-party content to which it merely provides access for use.
b) If a link to an illegal site is created intentionally, i.e. with knowledge and intent, this has the consequence that liability for the content of the external site is the same as for the content of one's own site.
We would also like to point out that the legal question of liability has not been fully clarified. According to a minority opinion, the person setting the link is already liable in the case of positive knowledge of the illegal content of the other website, without the need for wilful action.
The following therefore applies to the links to be placed on the www.bad-wildbad.de homepage:
a) As soon as there is positive knowledge of the illegal content when the link is set, the link must not be set.
